The Supreme Court sided with Republicans in Wisconsin on Monday, ruling 5-3 along ideological lines that Wisconsin can count only those absentee ballots that arrive by Election Day — even if they were mailed days earlier. Since first-class mail has been taking an average of 10 days to be delivered in the state, Wisconsin's Democratic Party urged mail-in Democrats to hand-deliver their absentee ballots or vote in person.The practical issue involves what happens with Wisconsin's 700,000 outstanding absentee ballots. "But the deeper issue is about the extent to which a ballot should be considered as valid," Phillip Bump writes in The Washington Post. In a factually sloppy concurring opinion, Justice Brett Kavanaugh evidently embraced President Trump's baseless conspiracies about voter fraud and bizarre demand that the winner be announced election night.Many states require absentee ballots to arrive by Election Day because they "want to avoid the chaos and suspicions of impropriety that can ensue if thousands of absentee ballots flow in after election day and potentially flip the results of an election," Kavanaugh wrote. "And those states also want to be able to definitively announce the results of the election on election night, or as soon as possible thereafter."Justice Elena Kagan, in her dissent, noted that "there are no results to 'flip' until all valid votes are counted. And nothing could be more 'suspicio[us]' or 'improp[er]' than refusing to tally votes once the clock strikes 12 on election night."More broadly, Kavanaugh — and Justice Neil Gorsuch — embraced late Chief Justice William Rehnquist's concurring opinion in 2000's Bush v. Fights Erupt During 'Jews for Trump' Rally in Manhattan

NEW YORK -- Political tensions over the upcoming presidential election escalated on New York City's streets Sunday, as supporters of President Donald Trump clashed with counterprotesters during a day of demonstrations.Eleven people were arrested, police said, during skirmishes between opposing sides in Manhattan, where Rudy Giuliani, the president's personal lawyer and the city's former mayor, encountered protesters targeting a caravan of cars organized by a group that identifies itself as Jews for Trump. All have been released except for a 36-year-old man who threw eggs in the faces of two police officers, police said.In one video, Giuliani could be seen in the passenger side of a vehicle with the window rolled down as anti-Trump protesters screamed at him.In an interview, Giuliani said that he had encountered the caravan and the protesters while driving down Fifth Avenue after taping his radio show."I would love to have had a campaign commercial of it and put it on in the middle of America and say, 'Who would you prefer for the next four years?" he said. Rioters Injure Thirty Police Officers in Night of Violent Unrest in Philadelphia

At least 30 police officers were hurt during rioting that broke out in West Philadelphia overnight after police fatally shot a man wielding a knife on Monday, authorities said.Rioters threw rocks and bricks at police and looted and vandalized businesses, NBC Washington reported. A 56-year-old sergeant was hospitalized after she was struck by a pickup truck, breaking her leg, among other injuries. The unrest broke out after police shot and killed 27-year-old Walter Wallace Jr., a black man, in Cobbs Creek. Wallace had a knife when he walked toward officers and ignored orders to drop his weapon, police said. Video of the incident appears to show Wallace approaching officers while his mother attempted to restrain him. The camera briefly points downward and the sounds of several gunshots ring out as police open fire. Wallace is then shown lying still on the ground while his mother, who is screaming hysterically, runs to him. Philadelphia mayor Jim Kenney, Police Commissioner Danielle Outlaw and District Attorney Larry Krasner said they would investigate the incident, while Fraternal Order of Police president John McNesby defended the officers in a statement. Looters took advantage of the unrest, breaking into a number of stores including several Rite Aid stores in West Philadelphia, clothing and shoe stores and at least one restaurant, NBC reported. At 57th and Vine streets, clothing and merchandise were thrown on the sidewalk. The ruling raises the possibility that the companies will simply end operations in the state altogether, both having stated previously that their business model depends on the flexibility of using contractors.The companies claim, and drivers often confirm, that the flexibility of contract work is key to their operations. Employers are required under federal and state law to schedule and track their employees’ hours for overtime, unemployment, and other purposes. That’s not case with contractors, who are legally considered independent businesses.Critics of the ride-sharing companies, such as California Gov. Gavin Newsom, claim that’s just a dodge to get out of paying overtime and complying with other workplace regulations. Labor unions have pushed for the drivers to be classified as employees, since contractors cannot join unions.A three-judge state appeals court panel on Thursday agreed, rejecting the companies’ arguments out of hand. The panel was in full crusader mode, calling the case a “reminder that the foundation of interim injunctive relief lies in equity comes from Justice Ruth Bader Ginsburg, who was renowned for her expertise in procedure long before she became the national icon known as RBG.”The panel said that there was just no reason to assume that forcing ride-sharing companies to operate as traditional employers would in any way hurt their business model, even as it conceded that that model was built around contractors.“We recognize that defendants’ business models are different from that traditionally associated with employment, particularly with regard to drivers’ freedom to work as many or as few hours as they wish, when and where they choose, and their ability to work on multiple apps at the same time,” it said.The “multiple apps” point, in particular, is worth noting, because that refers to the ability of drivers to work for multiple different app-based companies at the same time. In other words, the drivers can work for a company and its direct competitor, a situation no traditional employer would tolerate. But a business cannot automatically restrict a contractor from doing that. The ride-sharing companies don’t even try. If you’ve ever taken a ride in an Uber or a Lyft, you’ve probably also seen a sticker for the other service in the drivers’ window.The panel nevertheless argued the companies were employers because the ride-sharing service they provided was the core of their business model, rather than an incidental activity, pointing to a Supreme Court ruling called Dynamex. As for the possibility that the companies cannot function as traditional employers, the panel asserted that just couldn’t possibly be true.“The People counter, correctly, that a party suffers no grave or irreparable harm by being prohibited from violating the law,” the panel said.That is not true in the real world, however: An ill-conceived law can cause great damage. A good example can be found in the case of AB5 itself. In addition to scaring off many employers who use contractors, the law reined in contract work generally, strictly limiting what even traditional freelancers like photographers or musicians could do. State lawmakers were forced to amend the law and carve out exemptions for numerous professions. That’s clear proof that they had overreached. Freelancers still claim it’s too restrictive.It may yet get worse for Californians. If the state ballot’s Proposition 22 to roll back AB5 fails and the panel’s ruling stands, the companies have said they’ll simply stop operating the state. Customers throughout the state will have limited transportation options — a potential public safety issue, as Mothers Against Drunk Driving has warned. Meanwhile, numerous drivers will be left without a way to make the additional money that ridesharing offers at a time when Californians need the opportunity. The national unemployment rate is 7.9 percent, but the Golden State’s rate is 11 percent. California’s unemployment has been consistently higher than the national average throughout the year, and the state’s effort to reign in gig-economy companies has likely been a factor.

Atlanta rapper Silento was arrested Friday and accused of driving 143 mph (230 kph) on Interstate 85, authorities said. Silento, or Richard “Ricky” Lamar Hawk, was charged with reckless driving, speeding, failure to maintain lane and improper stopping, news outlets reported. A DeKalb police report said Hawk was pulled over around 3 a.m. after an officer witnessed Hawk's white BMW swerving around slower cars.
